CANCELLATION POLICY

Each listing on SubletMe displays its specific cancellation policy. If none is specified, SubletMe's default policy applies as follows:

1. Full Refund:
Cancellations made 30 or more days before the scheduled check-in date will receive a full refund of the paid amount.


2. Partial Refund (25%):
Cancellations made between 7 and 30 days before the check-in date will receive a 25% refund of the paid amount.

3. No Refund:
Cancellations made less than 7 days before check-in are not eligible for any refund.

4. After Check-In - No Refund:
Once the guest has checked in, no refunds will be issued under any circumstances, including but not limited to dissatisfaction with the apartment, early departure, change of plans, or any personal reason.

5. No-Shows:
Guests who fail to check in without prior cancellation are not eligible for any refund. If only a deposit was paid, the remaining balance will still be charged.

6. Host Cancellations:
If a host cancels a reservation after approval, guests are entitled to a full refund, including all fees and taxes paid.
In addition:
- More than 30 days before check-in: Host must pay a 10% penalty of the total reservation amount.
- Between 48 hours and 30 days before check-in: Host must pay a 25% penalty.
- Within 14 days before check-in: Host must compensate the guest an additional 10% of the total reservation amount.
- Within 48 hours of check-in or after check-in: Host must pay a 50% penalty of the total amount for the nights not stayed.

7. Force Majeure:
In the event of unforeseen circumstances beyond the control of SubletMe or the host (e.g., natural disasters, government restrictions, health emergencies), SubletMe reserves the right to adjust refund terms based on the specific situation.

8. Modifications:
Any changes made to the reservation by the guest (e.g., change of dates or shortening of stay) are subject to host approval and may affect refund eligibility or incur additional charges.

9. Disputes:
SubletMe will review disputes related to cancellations, refunds, or payments based on documented communication between guest and host. However, SubletMe is not liable for enforcing refund terms beyond what is outlined in this policy.

Welcome to SubletMe! These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Mia P Holdings LLC ("Company," "we," "us," or "our"), the operator of the SubletMe platform ("Platform"). By accessing, booking, or using SubletMe, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Overview of SubletMe SubletMe connects individuals seeking short-term rental accommodations with property owners or authorized sublessors. We facilitate communication and transactions between parties but do not own, manage, or control listed properties. SubletMe solely provides a matching service and is not a real estate agent or brokerage.

2. User Eligibility You must be at least 18 years old and capable of entering into a legally binding contract to use SubletMe. By using the Platform, you confirm you meet these requirements.

3. Account Registration
- Provide accurate, up-to-date information.
- Maintain the confidentiality of your account credentials.
- We reserve the right to suspend or terminate accounts for violations of these Terms.

4. Hosts
- Hosts must comply with all applicable local laws and regulations.
- Listings must be accurate and updated regularly.
- Hosts are responsible for setting their own cancellation and refund policies unless choosing SubletMe's default policies.
- Hosts are responsible for maintaining properties in safe, habitable conditions.
- SubletMe charges a service fee from hosts for each booking.

5. Tenants
- Tenants must comply with host rules and respect property conditions.
- Payment must be made as agreed.
- Tenants are responsible for damages caused during their stay.
- No service fee is charged to tenants.
- Disputes between tenants and hosts should be resolved directly.

6. Payments and Fees SubletMe collects payment from tenants. Funds (minus SubletMe's service fee) are released to hosts within 24 hours of deposit clearance into SubletMe's account.

7. Cancellation and Refund Policy Each listing displays its specific cancellation policy. If none is specified, SubletMe's default policy applies:
- Full Refund: Cancellation 30+ days before check-in.
- Partial Refund (25%): Cancellation between 7-30 days before check-in.
- No Refund: Cancellation less than 7 days before check-in.
- After Check-In: No refunds. Full payment is required if cancellation occurs after entering the property.
- No-Shows: Guests who do not arrive without cancellation will not be entitled to any refund.
- Host Cancellations: If a host cancels after reservation approval, tenants are entitled to a full refund.
- Force Majeure: In the event of natural disasters, government restrictions, or other unforeseen circumstances, SubletMe reserves the right to modify cancellation terms.

8. Prohibited Activities
- Provide false or misleading information.
- Use the Platform for illegal or fraudulent purposes.
- Discriminate against other users.
- Violate rental laws or platform rules.
- Interfere with or damage the operation of the Platform.

9. Liability & Indemnity
By using SubletMe or entering a rental property, you assume full responsibility for any injury, loss, property damage, or death caused by your actions or those of your guests.
You release SubletMe, Mia P Holdings LLC, its affiliates, owners, employees, and representatives from any liability for injury, loss, damage, or death occurring at the property, whether caused by negligence or otherwise. You indemnify and hold harmless SubletMe from any claims, liabilities, damages, or costs arising from your stay or use
of the property.

10. Guest Responsibilities
- You are responsible for damage caused to appliances, electronics, furniture, fixtures, or structures during your stay.
- No illegal substances, underage drinking, or other unlawful activities are permitted.
- Unauthorized pets are not allowed unless approved beforehand.
- SubletMe and the property owner are not responsible for personal belongings.
- Properties cannot guarantee to be pest-free; no refunds will be given for pest presence.
- Loud noise, violence, or disruptive behavior may result in eviction without refund.

11. Insurance Guests are responsible for carrying insurance to cover injuries, property damage, or personal belongings. Otherwise, guests agree to bear any costs arising from injuries, damages, or losses.

12. Dispute Resolution Disputes between hosts and tenants must be resolved independently. Any claims arising between a user and SubletMe will be settled by binding arbitration in accordance with the American Arbitration Association rules.

13. Modifications to Terms We may modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
